La révision de la 4ème directive anti-blanchiment (dite « 5ème directive anti-blanchiment »), lancée à l’issue des attentats terroristes perpétrés en Europe et dont la concertation était en cours au moment de l’affaire des « Panama papers », a fait l’objet d’un accord politique fin 2017.

Adoptée, la Directive a été publiée le 19 juin 2018 au Journal Officiel de l’Union européenne et prévoit un délai de transposition de 18 mois à compter de sa publication pour la plupart de ses dispositions.

Le projet de 5ème directive élargit le champ d’application des obligations de lutte contre le blanchiment des capitaux et le financement du terrorisme (LCB-FT), notamment aux acteurs dans le domaine des cryptoactifs. Il renforce également les obligations de vigilance à l’égard de la clientèle (i) en limitant davantage l’utilisation des produits de monnaie électronique dite « anonyme » et (ii) en précisant les mesures de vigilance renforcées à mettre en œuvre à l’égard des relations d’affaires et opérations impliquant des pays tiers à haut risque.
